Terms of use

Clear rules governing the use of KENTEKOD

These terms govern access to and use of the KENTEKOD platform by a client organization and its authorized users. By accessing the platform, the client organization accepts the terms described below.

This English version is provided for convenience. In case of discrepancy, the French version prevails.

1. Purpose and acceptance

These terms of use govern access to the KENTEKOD platform, operated by the KenTeKoD team, and its use by a client organization and the people it authorizes to sign in. By creating access, accepting a sign-in invitation or using the platform in any way, the client organization and its users acknowledge having read these terms and agree to comply with them.

2. Description of the service

KENTEKOD is a platform for managing information technology portfolios, programs and projects, bringing together planning, resource management, financial tracking, risk and compliance management, AI-assisted reporting, as well as cybersecurity modules (audits, asset inventory, incident management). The KenTeKoD team may also offer complementary consulting services in technology project management.

3. Accounts and access

Access to the platform is exclusively through Microsoft Entra ID authentication, with the user's work account — KENTEKOD neither creates nor manages any password. Each user is invited individually by an administrator of their organization or by the KenTeKoD team, and their access is limited to their own organization's data. Each organization is responsible for managing its staff's access, including promptly revoking access for a person who leaves the organization or changes role.

4. Plans, free trial and billing

KENTEKOD offers three plans (Essential, Professional, Enterprise), each giving access to a different set of features, billed per seat (licensed user) on a recurring basis. Every new organization benefits from a free trial period with full access to the platform; when this period ends, access is limited until a paid plan is activated. Billing is handled by our payment provider (Stripe); the client organization can manage its payment method, view its invoices and adjust its number of seats at any time through the billing portal provided to it.

5. Data ownership and confidentiality

Data entered into the platform by a client organization belongs to that organization. KENTEKOD applies strict technical isolation between client organizations and discloses, uses or shares this data only under the conditions described in our privacy policy, which forms an integral part of these terms.

6. Acceptable use

The client organization and its users agree to use the platform for lawful purposes consistent with its intended use (management of IT portfolios, programs and projects), and not to: attempt to bypass the data isolation between organizations or access data that does not belong to them; compromise the security, availability or integrity of the platform; use the platform to transmit illegal or malicious content or content that infringes the rights of a third party; share their sign-in credentials with an unauthorized person.

7. Service availability

KENTEKOD makes reasonable efforts to ensure the continuous availability of the platform, hosted on Microsoft Azure cloud infrastructure. Occasional interruptions may nevertheless occur for maintenance or update reasons, or due to circumstances beyond our control. We notify client organizations of major planned interruptions where possible.

8. Intellectual property

The KENTEKOD platform, its code, its design and its brand remain the exclusive property of the KenTeKoD team. The client organization receives a non-exclusive, non-transferable right to use the platform, limited to the duration of its subscription, and may not reproduce, decompile or redistribute the platform.

9. Limitation of liability

To the extent permitted by applicable law, KENTEKOD's liability to a client organization for any damage related to the use of the platform is limited to the amounts paid by that organization during the previous twelve (12) months. KENTEKOD cannot be held liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the platform.

10. Termination

A client organization may end its subscription at any time through its billing portal. KENTEKOD reserves the right to suspend or terminate an organization's access in the event of prolonged non-payment or significant breach of these terms, after reasonable notice where circumstances allow. At the end of the relationship, the organization may request the export or deletion of its data in accordance with our privacy policy.

11. Changes to these terms

These terms may be updated to reflect changes to the platform, our plans or applicable legal requirements. The version in force is always the one published on this page; client organizations will be informed of significant changes.

12. Governing law

These terms are governed by the laws applicable in the province of Québec and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
